1. Scope and provider

These General Terms and Conditions ("Terms") apply to all orders placed through the website gmmobileshop.com (the "Website"), operated by GM Mobile Shop, Gartenfelderstraße 29-37, 13599 Berlin, Germany. Full provider details, including contact information, are set out in our Impressum.

By placing an order you confirm that you have read and accepted these Terms. The version of the Terms published on the Website at the time of your order applies to that order. Deviating conditions of the customer are not recognised unless we expressly agree to them in writing.

2. Contract formation

The presentation of products on the Website does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum). By completing the checkout process and clicking the order button, you make a binding offer to purchase the goods in your cart.

After you place an order, you will receive an email acknowledging receipt of your order; this acknowledgement does not yet constitute acceptance. The contract of sale is concluded when we send you an express order confirmation or when we dispatch the goods, whichever occurs first. If we cannot accept your order (for example because an item is unavailable), we will inform you promptly and refund any payment already made.

3. Prices and shipping costs

All prices are stated in euros (EUR) and include statutory VAT at the applicable rate. Shipping within the European Union is free of charge; see our Shipping & Warranty page for delivery details. Because we ship only within the EU, no customs duties or import fees apply — the price displayed at checkout is the final price you pay.

4. Payment

Payment is made by online card payment processed by Viva Wallet (viva.com), a licensed, PCI-DSS-compliant payment service provider. Your card details are entered on Viva Wallet's secure payment page and are not stored on our servers. Your order is dispatched only after payment has been confirmed.

All charges are made in EUR. Prices shown on the Website in other currencies (such as USD or TRY) are indicative conversions for your convenience only; the amount actually charged to your card is always the EUR price, and your card issuer's exchange rate and any foreign-transaction fees may apply.

5. Delivery

We deliver to all member states of the European Union using tracked and insured courier services. In-stock items ordered on a business day are normally dispatched within 24 hours; estimated delivery times are stated on the Shipping & Warranty page and are indicative, not guaranteed. Where you are a consumer, the risk of accidental loss of or damage to the goods passes to you only when the goods are handed over to you (or to a person designated by you who is not the carrier).

6. Retention of title

The goods remain our property until the purchase price has been paid in full (Eigentumsvorbehalt).

7. Statutory warranty and guarantees

Consumers have statutory warranty rights (gesetzliche Gewährleistung) in respect of defects. For new goods, claims for defects generally become time-barred two years after delivery. These statutory rights are not limited by anything in these Terms and are free of charge.

In addition, every device we sell is covered by the 24-month warranty advertised on the Website, and manufacturer guarantees may apply alongside your statutory rights. A manufacturer's guarantee does not restrict your statutory warranty claims against us. To make a claim, contact info@gmmobileshop.com with your order number and a description of the fault; approved warranty returns are shipped at our expense.

8. Right of withdrawal

If you are a consumer, you have a statutory right to withdraw from the contract within 14 days without giving any reason. The full withdrawal instructions, the consequences of withdrawal and the model withdrawal form are set out on our Right of Withdrawal page, which forms part of these Terms.

9. Liability

We are liable without limitation for damage caused by intent or gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and in all other cases of mandatory statutory liability.

In cases of simple negligence, we are liable only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer regularly relies), and in such cases our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. This does not affect your statutory warranty rights or any liability that cannot lawfully be limited.

10. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).

11. Governing law

These Terms and all contracts concluded under them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory consumer-protection provisions of the law of the country in which you have your habitual residence.

12. Severability

Should any provision of these Terms be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the statutory rules shall apply.
